Terms and conditions of participation

Summary of the conditions:

Participation from 18 years old or older. Registration before Sunday 26th May 11:59 PM. No purchase necessary. To participate: Sign up for our newsletter via the Facebook/Instagram campaign. Complete terms and conditions:

Persons resident in Germany, the Netherlands, Austria, Czechia, Luxembourg, and Belgium who are at least 18 years old are permitted to participate, with the exception of employees of the organiser, their family members, representatives or other persons professionally connected with this promotion.

1. All entrants must ensure that their participation (including acceptance of any prize awarded) is legal and complies with the laws of the country in which they are a citizen and/or resident. This Promotion is void where it is invalid under local national laws. The Promoter makes no representations, express or implied, as to the legality of any person's participation or as to any other aspect of the Promotion.
2. No purchase is necessary; however, a valid e-mail account and Internet access are required.
3. Campaign period: 16th May 2024 until 11:59pm 26th May 2024
4. To participate: Fill out the form on Facebook/Instagram and sign up for the Sea to Summit newsletter.
5. Further details on participation:
   - Participants may only enter once.
   - Entrants should be contactable by email for a period of three months after the closing date.
   - All entries must be received by the closing date to be valid. No liability will be accepted for illegible, incomplete or late entries.
6. Prize: 1x Bundle with 1x Ultra-Sil Dry Bag (13L) + 1x Drylite Towel (L) + 1x Comfort Blend Sleeping Bag Liner (Rectangle with pillow sleeve) worth 113.80 € (RRP)
7. The prize is non-transferable, non-exchangeable and will not be paid out in cash. However, if an incorrect size is requested, winners may return the item to receive the correct size.
8. Winner selection: All valid entries will be entered into a draw to select a winner who will receive the prize.
9. The draw will take place within one month of the closing date for entries.
10. Moderation: The Organiser will reject entries that, in the reasonable opinion of the Organiser, contain content that could be considered offensive by the Organiser:

• Contain content that could be considered offensive by the Promoter or that could adversely affect the name, reputation or standing of the Promoter or any Brand Partner;
• disparages, misrepresents or offends any other person or company, including but not limited to the Promoter (including its partners)

11. Notification of winners:
    • Winners will be notified by email within five working days of judging and must confirm their eligibility and acceptance of the prize within 14 days of initial contact. If a winner does not respond to communications within 14 days of initial contact, the Organiser reserves the right to disqualify the winner and award the prize to another winner in the same manner.
12. Redemption:

• Winners will be contacted directly by a Sea to Summit representative to organise the redemption of their prize.
• Delivery of this prize is valid for Germany, Austria, Czechia, the Netherlands, Luxembourg, and Belgium.
• Winners may waive their right to receive the prize.
• In such cases, the prize will be forfeited and the Promoter will be entitled to deal with the prize as it sees fit. The Organiser may select another winner in the same manner as the original winner was selected. This selection is subject to the Terms and Conditions.
• If the Promoter chooses to send the prize to the winner by post, the Promoter accepts no responsibility for the safe and successful postal delivery of the prize.

13. The Prize:

• Prize winners are responsible for any taxes (if any) incurred as a result of the awarding or receipt of a prize.
• Prizes are accepted at the sole risk of the entrant and are awarded by the Organiser without any express or implied warranty of any kind. In order to receive the prize, the entrant must sign a release and indemnity form in the form prescribed by the Organiser if requested to do so.
• In the event that the Promotion is compromised by a virus, unauthorised human intervention, tampering or other causes beyond the reasonable control of the Promoter which corrupt or affect the organisation, security, fairness or proper conduct of the Promotion, the Promoter reserves the right to modify or terminate the Promotion at its sole discretion. Should the Promotion end before the stated expiry date, the Promoter reserves the right to deal with the prizes as it sees fit and may award the prizes based on the entries received by the end date.
• Winners should retain their prize confirmation email in order to claim the guarantee and accident replacement programme.

14. The organiser will use the personal data exclusively for processing the promotion and for no other purpose unless we have obtained the necessary consent. Click here to view the privacy policy.
15. Bulk entries from businesses, consumer groups or third parties will not be accepted. Entries that are incomplete, entries submitted by or through third parties or communities of interest, entries submitted using macros or other automated means, and entries that do not fully comply with the requirements of these Terms and Conditions will be excluded and will not be counted. If an entrant is found to be using one or more computers to circumvent this condition, e.g. by using ‘scripts’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or other automated means to boost that entrant's entries in a manner inconsistent with the purpose of the Promotion, that entrant's entries will be disqualified and any prizes already awarded to them will be void.
16. To the extent permitted by law, the Promoter shall not be liable to the winners for any loss or damage (whether in contract, tort [including (without limitation) negligence], statutory duty or otherwise) arising out of or in connection with the Competition and the Prize.
17. Neither the Organiser nor its agencies are responsible for the non-inclusion of entries due to technical errors or other causes, including errors within the control of the Organiser or its agencies. Proof of sending the entry is not proof of receipt of the entry. The Organiser accepts no responsibility for system errors or other problems that may result in lost, delayed or non-receipt of entries or prize notifications.
18. The winner may be asked to participate in appropriate promotional activities in connection with the promotion.
19. By entering the Promotion, entrants confirm that they have read and agree to these Terms and Conditions and the decisions of the Promoter, which are final in all matters relating to the Promotion. Failure to do so will result in forfeiture of the prizes.
20. If for any reason, including, but not limited to, tampering, unauthorised action, fraud, technical failures or other causes beyond the control of the Promoter which corrupt the administration, security, fairness, integrity or proper conduct of this Promotion, the Promotion cannot be completed as planned, the Promoter reserves the right (subject to any written instructions under applicable law) to disqualify any person who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
21. If any act, omission, event or circumstance beyond the Organiser's reasonable control occurs which prevents the Organiser from complying with these Terms and Conditions, the Organiser shall not be liable for any failure to perform or delay in performing its obligations.
22. This promotion is governed by Swiss law and participants submit to the exclusive jurisdiction of the Swiss courts.
